28TheParticipantsoutsidetheauctionvenuemaysubmitbidsusinge-BIDontheInternet.⑴Anaturaldisaster,incidentorotheremergencyhasoccurredorappearslikelytooccur;⑵AfailurehasoccurredtotheAuctionfacilitiesanditisunavoidabletocanceltheAuctions;or⑶OtherwisetheCompanyjudgesitnecessarytocanceltheAuctionsduetoanoperationalortechnicalreason.⑴CompetitiveauctionsareconductedfortheExhibitedMachines.TheParticipantsintheauctionvenuepressthebidbuttontobidfortheExhibitedMachineswithinatimeperiodsetbytheCompanyforthedesignatedincrementamount.⑵TheParticipantwhooffersthehighestbidpriceduringthecompetitiveauctionofeachExhibitedMachineshallbethesuccessfulbidder.IntheeventnoParticipanthasofferedthereservepricesetbytheCompany,theExhibitedMachinewillpassin.⑶ThesuccessfulbidderandhammerpricewillbedeterminedwhentheCompanyconfirmswiththesuccessfulbidderdeterminedundertheprecedingitemtheacceptanceofthebidusingtheconfirmationbutton.Ifthesuccessfulbidderdoesnotconfirmtheacceptanceofthebidusingtheconfirmationbutton,theCompanyshallhavetherighttoconfirmtheacceptanceofthebidonbehalfofthesuccessfulbidder.⑷TheParticipantmaynotwithdrawitsbids.Article9(NotificationofChanges)TheParticipantshallpromptlynotifytheCompanyofanychangetothenameoftherepresentative,address,telephonenumber,faxnumber,oranyotherinformationithassuppliedtotheCompany.Article10(DeregistrationbyParticipant)TheParticipantmayderegisteritselfasneededbyrequestingtheCompanytothateffectbythestipulatedmethod.Article11(ManagementofRegistrationNumbers)①TheParticipantshallberesponsibleformanagingitsRegistrationNumbertheCompanyhasprovidedtotheParticipant.②TheParticipantmaynotlend,assign,changethenameof,sellorpurchase,pledge,allowathirdpartytouse,ortakeothersimilaractionsconcerningitsRegistrationNumber.③TheParticipantshallberesponsibleforanydamagearisingfromtheinadequatemanagementof,mistakesinusing,usebyathirdpartyof,oranyothersimilarincidentsconcerningitsRegistrationNumber.TheCompanyshallassumenoresponsibilityforsuchdamage.④TheParticipantshallimmediatelynotifytheCompanyofanytheftofitsRegistrationNumberoranydiscoveryofitsusebyathirdpartyandshallfollowinstructionsgivenbytheCompanyinsuchcases.Article12(CancellationoftheAuctions)①TheCompanymaycanceltheAuctionswithoutadvancenoticetotheParticipantif:②TheCompanyshallassumenoresponsibilityforanydamageincurredtotheParticipantduetothecancellationoftheAuctionspursuanttotheprecedingParagraph.Article13(GeneralMattersconcerningAuctionBiddingProcedures)①AbidmadebytheParticipantintheAuctionsshallbedeemedtobeapurchaseofferofamachineexhibitedbytheCompanyintheAuctions(hereinafter,the“ExhibitedMachine”).②Whenabidisaccepted,asale/purchaseagreement(hereinafter,the“Sale/PurchaseAgreement”)oftherelevantExhibitedMachine(hereinafter,the“SoldMachine”)shallbeenteredintobetweenthesuccessfulbidderandtheCompany,uponwhichalltheresponsibilitiesconcerningtheloss,damage,consumptionandsoforthoftheSoldMachineshallbetransferredtothesuccessfulbidder.③IftheSale/PurchaseAgreementisterminatedunderArticle26,Paragraph3herein,theCompanyshallnotbeobligedtotreatasthesuccessfulbiddertheParticipantwhosubmittedthesecondhighestbidpriceafterthesuccessfulbidder,andmaydisposeoftheSoldMachineatitsowndiscretion.④TheCompanyshallassumenoresponsibilityforanyaccident,loss,damageandsoforthoftheExhibitedMachineatthetimeofitsinspectionbytheParticipantandoftheSoldMachineatthetimeofitscollectionbythesuccessfulbidderaswellasanyothersimilarcase,unlesssuchaccident,loss,damageandsoforthisattributabletotheCompany.⑤TheParticipantshallchecktheExhibitedMachinewhereitiskept.TheCompanyshallassumenoresponsibilityifthehourmeterreading,specifications,ageandotherdetailswrittenonalistoftheExhibitedMachinesdifferfromtheactualconditions.Furthermore,theCompanyshallassumenoresponsibilityforthequality,typeandvolume(includingstandards,specification,performanceandotherinformationoftheExhibitedMachinesrequiredbythebidder)oftheExhibitedMachines.Article14(AuctionProceduresforParadeAuctions)Paradeauctionsareconductedascompetitiveauctionspursuanttothefollowingprocedures.Article15(AuctionProceduresforOnlineAuctions)Onlineauctionsareconductedascompetitiveauctionspursuanttothefollowingprocedures.
