32Article27(Damage)①IfanyParticipantcausesdamagetotheCompanyinconnectionwithitsparticipationinoruseoftheAuctions,thesaidParticipantshallberequiredtocompensatetheCompanyforsuchdamage(includinglawyersʼfees).②IfanyParticipantcausesdamageto,oradisputewith,otherParticipantsorathirdpartyinconnectionwithitsparticipationinoruseoftheAuctions,thesaidParticipantshallresolvesuchasituationatitsownexpenseandasitsownresponsibility,andshallnotcauseanyinconvenienceordamagetotheCompany.Article28(GoverningLaw)TheAgreementsshallbeconcluded,takeeffect,beperformed,andbeinterpreted,inaccordancewiththelawsofJapan.Article29(CompetentCourt)IntheeventanylawsuitarisesasaresultoforinconnectionwiththeAgreements,theTokyoDistrictCourtortheTokyoDistrictSummaryCourtshallbetheexclusivecompetentcourtofthefirstinstance.Article30(EffectiveDate)TheAgreementsshalltakeeffectasofJune1,2021.ThefollowingprovisionsshallapplytotheParticipant.Article1①TheParticipantagreesthattheCompanymay,duringthetermasdeterminedbytheCompany,collect,retainandusethefollowinginformation(hereinaftercollectivelyreferredtoasthe“PersonalInformation”)afterimplementingsafeguardforthepurposesofanyofthefollowingItemsenumeratedinPurposeofUsebelow.1.Name,age,dateofbirth,address,telephonenumberandworkplaceoftheParticipantprovidedbyelectromagneticmethodsuchasthe2.Applicationdate,executiondate,nameoftheObjects,amountofcontractandnumberofpaymentswithregardtotheSale/Purchase[Purposeofuse]1.Provisionorsolicitationoftheusedpropertysalesandanyotherservicesrelatingtoorincidentaltotheusedpropertysales;or2.Deliverytheadvertisementandprintedmatteroftheparentcompany,subsidiary,affiliatesorbusinesspartneroftheCompanyafter②IntheeventtheCompanyengagesitsbusinesspartnertoperformallorpartoftheCompanyʼsoperationshereunder,theCompanymay,afterimplementingsafeguardforPersonalInformation,providesuchbusinesspartnerwiththePersonalInformationsocollectedpursuanttotheimmediatelyprecedingParagraph,andsuchbusinesspartnermayusethesame.Article2TheParticipantherebyagreesthattheCompanyandanyaffiliates(whichmeanstheaffiliatesaslistedinthewebsiteoftheCompany(https://www.tozaiboeki.co.jp/ja/))oftheCompanymay,afterimplementingthesafeguard,jointlyusethePersonalInformationassetforthinParagraph1ofArticle1,forthepurposesofcreditdecisionandcreditmanagementwithregardtocreditfacilitybusinessoftheaffiliatessuchasleasing,installmentsales,usedpropertysalesandfinancingservices,etc.Article3TheParticipantherebyagreesthattheCompanymay,afterimplementingthesafeguard,provideitsaffiliateswiththePersonalInformationassetforthinParagraph1ofArticle1,forthepurposesofadvertisement,introductionofbusinesses,sale,solicitationandintroductionoffinancialproducts,servicesandlifeinsurancepolicies,creditdecisionandcreditmanagementwithregardtothecreditfacilitybusinessoftheaffiliatessuchasleasing,installmentsalesandfinancingservices,etc.Article4①TheParticipantmayrequesttheCompanytodisclosethePersonalInformationregardingitself.PleasecontactthewindowassetforthinthewebsiteoftheCompanyifrequest.②IntheeventtheparticularsoftherecordedPersonalInformationareturnedouttobeincorrectorwrong,theCompanyshallpromptlyrespondtorequestforcorrectionordeletion.Article5IntheeventtheParticipantrequeststheCompanytostopusingthePersonalInformation,theCompanyshallstopusingthesamewithintheCompanyandprovidingtheothercompanieswiththesameeveniftheCompanyusesthesametotheextentoftheconsentgivenunderthetermshereof.《TermsofConsenttoCollection,Retention,UseandProvisionofPersonalInformation》Companyʼswebsite,e-mail,etc.orwritteninanyformsprescribedbytheCompany;Agreement;andreceivingtheirrequest.End(TZ-A004)
