29Article16(BiddingProceduresforTenderAuctions)Thebiddingproceduresfortenderauctionsareasfollows.⑴Intenderauctions,theParticipantsofferanamountatorabovetheminimumbidpricesetbytheCompanyfortheExhibitedMachines.⑵IftheCompanydecidesthatthelettersandotherinformationwrittenbyaParticipantonthebiddingformareillegible,theCompanymayArticle17(DeletionofInformation)①TheCompanymay,withoutnotificationtotheParticipant,deleteanyinformationprovided,obtained,orusedbytheParticipantthroughtheAuctionsif:⑴TheParticipantwhoprovided,obtained,orusedsuchinformationfallsunderanyoftheitemsinArticle26,Paragraph1herein;⑵TheCompanydeterminesthatsuchdeletionisnecessaryforthemaintenanceoftheAuctions;or⑶OtherwisetheCompanydeterminesthatitisnecessarytodeletesuchinformation.②TheCompanyshallassumenoresponsibilityforanydamageincurredtotheParticipantorathirdpartyasaresultofthedeletionof,orthefailuretodelete,informationundertheprecedingParagraph.Article18(Disclaimer)TheCompanyshallassumenoresponsibilityforanydamageincurredtotheParticipantduetotheprovisionofinformation,oranydelay,change,cancellation,orclosureoftheAuctions.Article19(GuaranteeandCompensation)①TheCompanyshalldelivertothesuccessfulbiddertheExhibitedMachineonan“asis”basis.Giventhecharacteristicsofsecond-handmachines,theCompanyshallgivenoguaranteeontheirperformance,forms,quality,oranyothersimilarpoints.②TheCompanyshallassumenoresponsibilityfornon-conformanceofthequality,etc.oftheSoldMachine,andshallnotacceptanycancellationoftheacceptanceofthebidfortheSoldMachineonthegroundofanyfailure,performancedeterioration,andsofortharisingfromsuchdefect.③TheCompanyshallassumenoresponsibilityforcompensatingfororpayinganychargeordamageincurredtothesuccessfulbidderasaresultoforinconnectionwiththeSoldMachine.④TheCompanyshallassumenoresponsibilityforcompensatingorpayingforanyinjuriesorotherdamagerelatedtothelifeorbodyoftheParticipantsoranypropertydamageincurredtotheParticipants,attheauctionvenue.⑤Stabilityofbiddinginonlineauctionsandthroughthee-BIDservicelargelyreliesonthecommunicationenvironmentoftheParticipantsandtheCompany.TheCompanyshallassumenoresponsibilityforcompensatingorpayingforanydamageincurredtotheParticipantsduetothedelayornon-arrivalofbidsoranyotherfailuresarisingfromthecommunicationenvironmentofeithertheParticipantsortheCompany.Article20(PriceandPayment)①TheindicativepricesfortheExhibitedMachinesintheAuctionsshallalwaysbegiveninJapaneseyenandshallnotincludeconsumptiontax.Theindicativepricesshallalsobeonan“asis,whereis”basis.②TheCompanyshallchargethesuccessfulbidderthesaleamountplusconsumptiontaxesandothernecessarycharges.Thesuccessfulbiddershallpay,withintwoweeksfollowingthedayoftheacceptanceofthebid(orwithinoneweekinonlineauctions),theentireamountchargedbytheCompanyincash,bymakingpaymenttotheCompanyattheexpenseofthesuccessfulbidder.TheCompanyshallnot⑴CompetitiveauctionsareconductedfortheExhibitedMachines.TheParticipantsbidfortheExhibitedMachinesdisplayedontheCompanyʼsauctionwebsitethroughtheInternet.⑵TheParticipantwhoofferedthehighestbidpricebeforetheclosingofthecompetitiveauctionofeachExhibitedMachineshallbethesuccessfulbidder.IntheeventnoParticipanthasofferedthereservepricesetbytheCompany,theExhibitedMachinewillpassin.⑶TheCompanyshallnotifythebiddingresulttotheParticipantswhomadebidsbyemail.Thisemailshallbethenoticeoftheacceptanceofthebidtothesuccessfulbidder.⑷ThesuccessfulbidderandhammerpriceshallbedeterminedwhentheCompanysendsemailintheprecedingitem.⑸Thesuccessfulbiddermaynotwithdrawitsbid.nullifysuchbidswithoutnotifyingtheParticipant.⑶TheParticipantmaymakeonlyonebidforeachofthedifferentExhibitedMachinesduringthebiddingperioddesignatedbytheCompany.TheParticipantmayalsorebidfortheExhibitedMachineforwhichithasalreadysubmittedabid,inordertoincreaseitsbidprice.IftheParticipantrebidsforthesameExhibitedMachine,thehighestamountofferedbythesaidParticipantshallbedeemedthebidpriceofferedbythesaidParticipantfortherelevantExhibitedMachine.⑷TheParticipantmaynotwithdrawitsbids.⑸TheCompanywillopenbidsaftertheclosingofbidding.TheParticipantwhooffersthehighestbidpriceamongthevalidlysubmittedbidsshallbethesuccessfulbidder.IftherearetwoormoreParticipantswhoofferedthehighestbidprice,theCompanyshallchooseonesuccessfulbidderinarandomdrawing.
